Biographical / Historical
The Queer Legal Collection documents the development of queer rights jurisprudence in India from 1994 to c.2025. It focuses on constitutional litigation concerning sexual orientation, gender identity, intimate relationships, and fundamental rights, with particular attention to challenges to Section 377 of the Indian Penal Code. Seven cases form the core of this collection: The ABVA Petition, Naz Foundation v. Government of NCT of Delhi and Others, Suresh Kumar Koushal and Anr. v. Naz Foundation and Others, National Legal Services Authority v. Union of India and Others, Justice Puttaswamy v. Union of India, Navtej Singh Johar v. Union of India, and Supriyo v. Union of India. The collection brings together legal materials from proceedings presented before the Supreme Court of India and multiple High Courts, situating court cases within a broader history of legal advocacy and constitutional interpretation. Taken as a whole, the collection traces the contested and evolving recognition of queer rights within Indian constitutional law, reflecting both landmark advances and continuing limitations in legal protection.
